"Fatality...the head of a company has been put on trial..."

Responsibility after a fatal incident is commonly decided upon the judicial system in the country where the incident occurred. Here is a recent story involving a company CEO that is being held responsible for the death of a worker.

In connection with the death of a worker who was working on removing the rubber gasket of an extruder cylinder, the head of an aluminum product manufacturing company has been put on trial for violating the Serious Accident Punishment Act. (local) District Prosecutors' District Office Criminal Division (Chief Prosecutor) indicted A's aluminum product manufacturing company and its representative B in Ansan on the 22nd for violating the Serious Accident Punishment Act and the Occupational Safety and Health Act.

The accident occurred in May 2022 when a worker was killed by a cylinder and structure that protruded along with the rubber seal while removing the aging rubber seal of the main cylinder of the extruder at Company A. It is reported that while pulling the rubber seal with an overhead crane, the main cylinder moved under strong force and jumped out, causing the worker to get stuck and die.

As a result of the investigation, it was found that the CEO, did not take safety measures to prevent accidents, such as prohibiting the use of the crane for other purposes and assigning work conductors, even though there was a risk of a safety accident if the overhead crane was used to remove the rubber seal instead of its intended purpose.

In order to remove the rubber seals, it is necessary to use a device called a 'lever fler', but the crane was used for a different purpose.

An official from the District Office said, "The prosecution will continue to respond strictly to serious accident cases in accordance with evidence and legal principles so that the lives and safety of workers can be more thoroughly protected."
